These Terms & Conditions ("Terms") govern your access to and use of dataflowcontrols.com (the "Site"), operated by DataFlow Controls ("we", "us", "our").

Services and project engagements

Use of the Site does not by itself create a client, advisory, or contractor relationship.

If you engage us for services, the governing terms for that work will be set out in a separate written agreement (for example, a proposal, statement of work, or master services agreement). If there is a conflict, that separate agreement controls for the applicable services.

You may not reproduce, modify, distribute, create derivative works from, publicly display, or exploit Site content except with prior written permission or as otherwise permitted by law.

Third-party services and links

The Site may include links to third-party websites and embedded services (for example scheduling tools). We do not control third-party services and are not responsible for their availability, content, security, or practices.

Your use of third-party services is governed by their own terms and policies.

Your use of the Site is also subject to our Privacy Policy, which describes how we collect and use information.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAFLOW CONTROLS AND ITS AFFILIATES, OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless DataFlow Controls and its affiliates, owners, employees, and contractors from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Site;
Your violation of these Terms; or
Your violation of applicable law or third-party rights.
