Informational and professional disclaimer
The Site content is provided for general informational purposes about our consulting, software, and manufacturing data services.
Any examples, insights, assessments, dashboards, recommendations, or performance statements on the Site do not constitute guaranteed outcomes and should not be treated as engineering, legal, accounting, or other professional advice for your specific operation without a direct engagement.
Services and project engagements
Use of the Site does not by itself create a client, advisory, or contractor relationship.
If you engage us for services, the governing terms for that work will be set out in a separate written agreement (for example, a proposal, statement of work, or master services agreement). If there is a conflict, that separate agreement controls for the applicable services.

All content on the Site, including text, graphics, branding, logos, layout, and software components, is owned by DataFlow Controls or its licensors and is protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your internal business evaluation and informational use.
You may not reproduce, modify, distribute, create derivative works from, publicly display, or exploit Site content except with prior written permission or as otherwise permitted by law.
Third-party services and links
The Site may include links to third-party websites and embedded services (for example scheduling tools). We do not control third-party services and are not responsible for their availability, content, security, or practices.
Your use of third-party services is governed by their own terms and policies.
Privacy
Your use of the Site is also subject to our Privacy Policy, which describes how we collect and use information.

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAFLOW CONTROLS AND ITS AFFILIATES, OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless DataFlow Controls and its affiliates, owners, employees, and contractors from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Site;

- Your violation of applicable law or third-party rights.
Governing law and dispute venue
These Terms and any dispute relating to them or the Site are governed by the laws of the United States and the State of Tennessee, without regard to conflict of laws principles.
You and DataFlow Controls agree that exclusive venue for disputes will be the state or federal courts located in Tennessee, and each party consents to personal jurisdiction in those courts.
Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
